All the counsels appearing for the respective parties are ad idem with the issue involved in the present petitions stands finally adjudicated by this Court while delivering the judgment passed in bunch of writ petitions with the lead case, C.W.J.C. No. 11447 2018 (Md. Ejaz Kausar Khan & Ors. Vrs. State of Bihar & Ors.), decided on 27th July, 2022. Learned counsels for the petitioners submit that they have been after having worked for a considerable period, their services were dispensed with by issuing an order in a similar format filling-up the blank lines purportedly after issuing show

Those petitioners who are continuing in terms of the interim order passed by the Court in their cases, shall continue to perform their duties and be also entitled to received salary from the date it was stopped by the respondents. The salary shall be released within a period of two months. The petitioners would be also entitled to receive interest at the arrears of salary. rate of 6% of their 30. Those petitioners whose services were dispensed with shall be entitled to reinstatement with continuity in service and would be also entitled to payment of their salary as above. However, for the period they have not worked, they will be only given benefit of notional salary following principles of no work no pay. The petitioners would be now allowed to continue as regular teachers as per the scheme. The petitioners shall be granted the same status as granted to other volunteers of the Taleemi Markaz who have been taken over by the State Government.”
